What is Comprehensive Home Insurance?

Comprehensive or Multi-Risk Home Insurance is designed to protect residential buildings and their contents (furniture, valuables, etc.) against potential damages caused by unforeseen events.

In addition to property protection, these policies include civil liability coverage, ensuring financial protection if the policyholder is held responsible for damages caused to the owner, neighbors or third parties.

While highly recommended, comprehensive home insurance is not legally required for homeowners or tenants in Morocco.

What does the Comprehensive Home Insurance Policy Cover ?

The multi-risk home insurance contract guarantees in particular :


Damage to Real and Personal Property 


“Fire and related risks “ cover  


The Fire and Related Risks coverage protects the policyholder’s property against damages caused by specific events outlined in the contract, including :

  • Fire: Damage resulting from conflagration, flashover, or simple combustion.
  • Explosion and Implosion: Covers explosions of gases used for heating, lighting, or power, as well as steam appliance blasts.
  • Lightning Strikes: Damage caused by the direct impact of lightning.
  • Smoke Damage: Covers smoke resulting from a sudden, abnormal, or defective heating appliance or from an external fire affecting the insured property.

For an additional premium, this coverage can be extended to include:

  •  Riot and Civil Commotion: Protection against material damage caused by fire or explosion due to riots or disturbances.
  • Holiday/Leisure Coverage: Ensures protection for the policyholder's movable property taken on trips or private journeys.

" Water Damage or Frost Damage " cover 


Damage to policyholder property caused by the events listed in the contract is covered, including:

  •  Leakages, breaks, overflows and seepage of water from the supply, distribution or discharge of rainwater, domestic water and waste water serving the policyholder building, water-operated appliances including washing machines (clothes or dishes), central heating installations, water or steam heating systems, sprinkler systems, accidental seepage through roofs, including terraces and skylights, caused by rain, snow or hail, sewer back-up not caused by weather conditions...
  • Freezing of fixed water, steam or heating appliances or pipes that are not underground.

For an additional premium, the "Water Damage or Frost" cover can be extended to include the following guarantees :

  • The costs of searching for leakages which are the cause of an policyholder loss and the restoration of property damaged by the detection work;
  • The cost of repairing pipes, ducts, installations and water-effect equipment damaged by frost, provided that they are located inside buildings.

Civil Liability Coverage 

 

Liability to Neighbours and Third Parties 

This coverage applies when the policyholder is an owner, co-owner, tenant, or occupier. It protects against the financial consequences of civil liability towards neighbors and third parties, as defined by Articles 78, 85, 86, 88, and 89 of the Dahir forming the Code of Obligations and Contracts. It covers material damage resulting from incidents under the "Fire and Related Risks" or "Water Damage and Frost" covers occurring in the insured building.

Tenant’s or Occupier’s Liability Towards the Owner and Co-Tenants 


When the policyholder is a tenant or occupier, this coverage protects against civil liability towards the owner (Articles 675 and 678 of the Dahir) and co-tenants. It applies to material damage caused by events covered under the "Fire and Related Risks" or "Water Damage and Frost" covers within the insured property.


Owner’s Liability Towards Tenants  


For policyholders who own the insured property, this coverage protects against financial liability towards tenants. It applies to material damage resulting from "Fire and Related Risks" or "Water Damage and Frost", as well as damages due to construction defects or lack of maintenance.


Private Life Liability 


This coverage protects the policyholder from financial consequences of civil liability for bodily injury, material damage, and consequential losses caused to third parties. It applies to incidents occurring in private life, including during commutes between home and work. Coverage is based on Articles 78, 85, 86, 88, and 89 of the Dahir forming the Code of Obligations and Contracts.
 

Under Article 64-1 of the Insurance Code, comprehensive home insurance contracts include mandatory coverage against the consequences of catastrophic events.

What does the Authority do ?

Within the framework of the powers vested in it by Law No. 64-12  establishing the Insurance and Social Security Supervisory Authority (ACAPS), the latter institution ensures that any and all insurance products offered to consumers are understandable, balanced, useful and that they comply with the regulations in force.

It also shall monitor the reliability of the information provided to policyholders and ensure the fair treatment of policyholders by Insurers.

Legal/Judicial Remedies in Case of Dispute with Your Insurer

Under Article 7 of Law No. 64-12, ACAPS   is authorized to investigate complaints from policyholders regarding insurance companies and intermediaries (brokers).
However, it is recommended to first contact the broker or insurer concerned. If the dispute persists, the policyholder may submit a complaint to ACAPS through the available channels. The Authority will then examine the case and take appropriate action in accordance with the applicable legal and regulatory provisions.
