ACAPS is in charge of defining supervisory methods of the operators of the pension sector. It prepares and oversees the publication of circulars through which it sets the rules and procedures of the monitoring. It also proposes draft decrees to the government.

In order to carry out its tasks under the best conditions, the Authority is adapting the legislative and regulatory framework by setting the prudential rules and monitoring procedures of the social welfare bodies. The Authority designed the necessary regulatory framework for implementing the provisions of Law No. 64-12 on the regulation and monitoring of pension funds by developing of a series of circulars:

 

  • Circular of the Chairman of the Supervisory Authority of Insurance and Social Welfare No. 1/PS/16 of 10 November 2016 setting out the list of documents to be produced for an application for approval of the statutes of a pension organization
  • Circular of the Chairman of the Authority n°2/PS/18 of 19 July 2018 on the documents to be produced by persons of Public Law practicing or managing pension operations;
  • Circular of the Chairman of the Supervisory Authority of Insurance and Social Welfare No. 3/PS/19 of 4 March 2019 regarding the supervision of pension organizations operating under private law;
  • Circular of the President of the Supervisory Authority of Insurance and Social Welfare No. PS/8/21 of 3 August 2021 setting the conditions for the constitution, assessment, representation and deposit of technical provisions and the equalization reserve by the Caisse Nationale de Retraite et d'Assurances (CNRA) as well as the documents to be produced by this institution.
